CONROE, Texas (AP) — A judge has decided to drop a contempt citation against a 17-year-old Houston-area high school honors student whom he jailed overnight for truancy.

Lanny Moriarty, who’s Montgomery County Precinct 1 justice of the peace, said Wednesday that he will clear Diane Tran of any criminal record. So says her attorney, Brian Wice.

Moriarty had cited the Willis High School junior for truancy last week and jailed her for 24 hours. Tran said, however, that she occasionally missed morning classes because of exhaustion from working two jobs to support herself and her siblings. She had told KHOU-TV of Houston that their parents had divorced and left them on their own.

Reports of her case sparked outrage nationally, and her Facebook page raised tens of thousands of dollars toward her college tuition.
